Owning Adivasi Land

Hi,

Can anybody let me know if one can own adivasi land. Also if not, is it possible to take it on long term lease.

Dear Abhishek,

As per Revenue Rules, Adivasi land can NOT be BOUGHT. If it is taken on lease, it is a compromise between the two (Adivasi and Land tiller). Please study Revenue Rules as well as see classificatin of land owned by the Adivasi because most of the time it is seen that Govt has allotted land to landless under ceiling act and classification of such land is Class II which can not be sold, mortagaged to bank (Except Co-op Bank) etc. Even if somebody desires to sell the Land (Class II), he will have to first arrive at market cost to be ascertained by Town Planner, then submit application to Collector who will forward with his remarks to Divisional commisioner who can sanction the sell of such land but condition is if the land is sold, half the amount is to be deposited by the owner in Govt treasury. The title of the land still remains same viz Class II. So please be careful while purchasing agri land.

Please note that you cannot buy any ADIVASI LAND in Maharashtra. Real Estate agents may weave any story & the unsuspecting type keep getting cheated. The land thus purchased will not be registered & no title will be ever available to you.However, you may take on lease ADIVASI LAND in Maharashtra with the prior permission of the Dist. Collector. Such permission is granted for only 5 years at a time & no more.Revenue department officials can guide you through the process for leasing ADIVASI LAND in Maharashtra.
Be careful & don't fall in the trap of any unscrupulous RE agent.

if suppose that land was purchased by adivasi from open cast person

Hi,

just want to know. have a land which was purchased by adivasi person in 1970 from open cast person. there is no record till date in 7/12 or in 8A as a adivasi. it is class 1 land. so will that adivasi person sale that land to open cast person without any collector order or he required order.

Need urgent revert...plz..
