Consequences of NRI buying agricultural land in India(Punjab)

If a NRI(Canadian Citizen) has purchased agricultural land in India(Punjab) when FERA was applicable in the year 1997,then what consequences or penalty would be charged now for the same??Will that land be confiscated by the govt or any criminal action taken against him?

Also if a person buys such land from that NRI,then what consequences can result on the buyer?

Nri buying agriculture land in india

hello 1.-NRI cannot buy agriculture land in india,and if he has purchased land he is bound to pay panelty under section 13 of FEMA act.

Hi Gursminder....thanks for your reply....can you please let me know that what penalty needs to be made in detail or guide me a link which has clear information stated about this(some notification or law)....After paying this penalty,will that land become legal?
 

Dear Rahul:

There are lot of variables which comes into effect. For instance, if the land was bought after you acquired the Canadian Citizenship, the penalties would be different. If the land was bought way earlier than you acquired the citizenship, the severity could be minimal. Also you would have options of transferring the land to your other family members who are in India. The best go for you, at this moment of time, is to consulat a lawyer, because they can help you provide a alternative solutions. Good Luck-

My friend, it could become a problem, when you try selling it, and you don't have proper ID ( Indian). OR some one go and complain ( probably your friends and relatives whom you might be counting on), by spending some money to screw you up. So please do not worry too much until some thing happens. Just stay low.
